bagan-balloon.com (the "website") is owned, operated and provided by MANDALIS Pte. Ltd. (or “we”). All pages, content, structure of pages and the online reservation service (the "service") are the property of MANDALIS Pte. Ltd.
By accessing, browsing and using bagan-balloon.com (the "website") and/or by clicking on the “Book” button through bagan-balloon.com, you acknowledge and agree to have read, understood and agreed to the terms and conditions defined below.
In case you do not agree to be bound by the terms and conditions, please cease the use of the website immediately. The terms and conditions apply to all our services.
2. Scope of our Service
Through bagan-balloon.com (the “website”) we provide an online platform to book an hot air balloon ride in Myanmar (or Burma).
By making a booking through bagan-balloon.com, you enter into a legally binding contractual bond with the ballooning company at which you book your ride. From the moment you make your booking, we act solely as an intermediary between you and the ballooning company, transmitting your contact and booking details to the relevant ballooning company and sending you a booking confirmation email on behalf of the ballooning company. Every effort is made to ensure the ballooning company processes your booking correctly.
The information that we disclose within the ride description is based on the information provided to us by the ballooning company. The ballooning company owners or their representatives are fully responsible for updating rates, availability, pictures, booking conditions and any other information which is displayed by them through bagan-balloon.com.
We are not able to verify and cannot guarantee that all information provided to us by the ballooning company is accurate, complete or correct, nor can we be held responsible for any typographical and translation errors or any other error made by the ballooning company.
We are not liable for any interruptions, breakdown, repair, upgrade or maintenance of our website leading to inaccurate, misleading or untrue information or non-delivery of information.
We will indicate the acceptance of your booking via a confirmation e-mail. Without the e-mail confirmation the acceptance of your booking might not be confirmed.
In extremely rare cases, we may have to cancel a booking due to obvious errors such as a mistake in pricing, which a reasonable person would not consider to be normal. The amount charged will be reimbursed without charge.
In extremely rare cases, we may have to change your booking once it is confirmed. If we do make changes then we will inform you as soon as we reasonably can. We reserve the right to make changes that are not significant and to correct your booking details at any time.
Rapid changes in the economical or the political context in Myanmar (or Burma) may occur which may make information displayed on bagan-balloon.com inaccurate or outdated.
bagan-balloon.com uses very high ethical standards and respects your privacy far better than most other online travel agencies. We will not disclose your personal information to third parties without your consent.
Since we use PAYPAL as our payment gateway, we don't keep your credit card details in our system.

4. Intellectual property
You are not allowed to republish material (including without limitation text, images, maps, audio or video material) from this website on another website or any other support without our consent. The entire content of the website is protected by copyright law. You may use information from bagan-balloon.com for your own personal use only.
This website may be linked to other websites that are not maintained by us. We are not responsible for the content of those websites.
We do not assume any liability for materials provided by third parties (example: travel agency or hotel) or any intellectual property right infringements by such third parties.
5. Additional fees
Unlike many other online travel agency, we will not add any unjustified additional fees to the travel services upon arrival. Prices displayed during payment are in most cases the final price unless we have to apply additional taxes.
No credit card information is transiting through us. All payments are done via PAYPAL, which accept a variety of payment options. PAYPAL is one of the safest ways of payment on internet but we can't be liable on PAYPAL's behalf in the event of credit card fraud or unauthorized use of your credit card by third parties.
In order to make a booking you must be over the age of majority in your country and have the full legal capacity to make the transaction.
All prices on descriptions are per travel service. Prices are usually displayed including taxes.
Once your booking is confirmed, the price of your travel service will not change. If you wish to cancel any booking, the total amount paid will be forfeited.
The currency conversion is for information only and should not be relied upon as fully accurate rate. Currencies are constantly fluctuating. Our official currency is US Dollar.
8. Confirmation Email
Due to unreliable internet (Power cuts, internet breakdowns...) in Myanmar, you might not get the Confirmation Email immediately, contact us to get the follow up of your booking. We are not liable in case the confirmation email is blocked in the Spam folder of your mailbox.
9. Passport and visa
You must ensure that you have a valid passport and a valid Myanmar visa before entering Myanmar or (Burma). Information about passport and visa requirements could be obtained through www.birma.com. We are not liable for any loss incurred in the event of your failure to hold a valid passport or visa.
It is your responsibility to ensure that you are fit to travel and participate in all of the services and activities you have booked. Information about health in Myanmar could be obtained through www.birma.com.
Please note that Myanmar is not a country with facilities for handicapped people. We can not be liable for any lack of facilities for handicapped people or injuries due to a handicap. We can not be liable for any illness or accident during your stay in Myanmar.
Any passenger with a body weight in excess of 125kg/280lbs, or any passenger requiring the space of 2 passengers in the balloon basket, is required to pay a 100% surcharge of the ticket price. Failure to provide accurate information in advance may lead to the refusal of flight at the launch site, whereby no refund will be offered.
For your own protection, you must have a travel insurance (including an insurance to cover the costs of cancellation of your holiday) for the full period of your holiday. Please note that it is your responsibility to ensure the insurance you purchase is suitable and appropriate to travel in Myanmar.
12. Cancellation and no-show
By making a reservation with bagan-balloon.com, you accept and agree to a non refund policy when you book. If you wish to cancel or adjust your reservation, please contact your ballooning provider by email.
In the event of cancellation on your side, 20% cancellation charge for cancellations within 7-60 days of the flight date, 100% cancellation charge will apply for cancellations less than 7 days before the flight date.
In the event of cancellation on the ballooning operator side, for safety reasons or as a result of unfavourable weather or operational difficulties will be refunded in full. Contact us to follow up the refund process.
In the event of no-show, your payment will be subject to a non refund policy.
13. Age and height
Children aged between 8 and 16 years must have their own flight ticket. There is no concessionary fare for children. However, in order to fly, they must be over 137cm tall (4 feet 6 inches) and need to be accompanied by a paying adult. When booking for such children, please make sure you also make a corresponding booking for an accompanying adult.
We are not liable in the event that the provision of the services and facilities you have booked are compromised by an event beyond our control or the control of your travel agency or hotel. Such events include, but are not limited to the following: War, riot, civil disturbance, actions of national or local authorities, nuclear disasters, tsunami, earthquake, natural disasters, fire, flood, any weather conditions, technical problems of transport, airports being closed, cancellation or changes of scheduled transports...
We or your ballooning operator will not be liable in any circumstances where any death, injury, illness or other loss or damage has been caused by a third party.
Your balloon operator may terminate its services if you are behaving in a way which will cause or be likely to cause danger or distress or annoyance to others or to damage property. If this happens, we are not liable to you in any way and it will be your responsibility to make your own travel arrangements.
Our liability is excluded or limited to the maximum extent permitted by law. We are not liable for any service outside our job (Our job is to facilitate the booking of travel services). Our liability shall at any event not exceed two hundred United States dollars.
You undertake that the details you provide us when making a booking are all correct.
You are bound by the local laws and regulations of Myanmar when you are in Myanmar.
We are not the vendor collecting and remitting taxes to the applicable taxing authorities, we only act as a booking facilitator.
The contents and information on our website are owned by MANDALIS Pte Ltd. located in Singapore.
To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Singaporean law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Singapore.
Translated versions of the original English terms and conditions is a courtesy, in the event of a dispute about the content or interpretation of these terms and conditions, the English language version of the terms and conditions shall prevail. The English version can be accessed on bagan-balloon.com by selecting the English language.
If any provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable and/or non-binding, the other provisions will continue in effect. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

We facilitate the booking of travel services including accommodation in Myanmar (Burma). We do not provide, own or run any travel services ourselves and we do not provide, own or run any accommodation.
